Application of the General Conditions of Sale
In the absence of any specific stipulation in these conditions and agreed in writing between the parties, orders are automatically subject to these general conditions of sale regardless of the clauses that may appear on the buyer’s documents. These conditions are apply to the sale of “House of Wine” products on its store accessible via the Internet. They are automatically made available to the buyer on the home page of the “House of Wine” site.
All the buyer has to do is click on “General Conditions of Sale” to find out the conditions of their order, even before they have started the order process. Consequently, placing an order implies the buyer’s full and unreserved acceptance of these General Terms and Conditions, to the exclusion of all other documents such as prospectuses, catalogs issued by the seller and which have only value. indicative.
The fact that the seller does not avail himself at a given moment of any of the provisions hereof cannot be interpreted as a waiver of subsequently availing himself of any of the said conditions. All our offers are within the limits of available stocks without obligation and unless sold in the meantime. Considering the rare or speculative nature of certain products, restrictions on the quantities available may be applied. In such a case, the quantity available is limited per household (same name, same address, same email address, same account or bank card holder). “House of Wine” therefore reserves the right to refuse an order in the event of doubt about the existence of a previous order for such a product.
Order process
First the customer makes an order request for the products he wishes to purchase, a request which he confirms with a confirmation click. Availability is confirmed with a return email.
In the event of a stock shortage of the wine ordered, “House of Wine” will inform the customer as soon as possible. In agreement with the customer, “House of Wine” may modify the order, for example by the following vintage or by an equivalent wine.
If the entire order is completed, an invoice will be issued by “House of Wine” and sent to the customer by email. The customer is then invited to go to the “House of Wine” website for payment.
Payment for items and/or services purchased from “House of Wine” is payable in full upon final order.
Payments are made by Payconiq Digicash or by bank transfer.
The order is prepared when “House of Wine” has received payment.
Delivery
Delivery of the item(s) ordered is made to the buyer’s home or to any address indicated when ordering, from receipt of the order form and payment (except in cases of force majeure). Delivery time for each product is indicated in the respective product description. Delivery times for products already ordered are re-indicated in the order confirmation received by email. If you have ordered several products with different delivery times, the longest delivery time applies to the entire order.
This delivery time is indicated as accurately as possible, but it may vary depending on the supply and transport possibilities of “House of Wine”, as well as climatic conditions.
Exceeding delivery times cannot give rise to damages, deductions or cancellation of orders in progress. However, if one month after the customer’s written complaint, the goods have still not been delivered, the sale may then be resolved at the initiative of either party. The customer will obtain restitution of his payment to the exclusion of any other compensation or damages, within one month at the latest.
In any event, on-time delivery can only occur if the customer has communicated to the seller exact information on the recipient’s contact details. In the event of an error, House of Wine cannot be held responsible for the impossibility of delivering the goods at the appropriate place and time.
Upon receipt of the goods, it is the recipient’s responsibility to check the condition of the goods upon receipt and to make all necessary observations in the event of breakage, damage or missing items, by expressing their reservations on the delivery slip, and within 48 hours following receipt of the goods, by registered letter with acknowledgment of receipt to the carrier, with a copy to the seller, in order to preserve his rights.
Price determination
In the Grand Duchy of Luxembourg
The price mentioned on the site is inclusive of all taxes.
It includes in particular the applicable VAT, excise duties and all other applicable taxes as well as transport costs in the Grand Duchy of Luxembourg, except sale and without commitment, subject to typographical and display errors. Free delivery from €250, a flat rate of €10 will be charged for any order below this amount.
From our warehouse in Strassen
If the non-Luxembourgish customer wishes to take advantage of the much more advantageous Luxembourg taxes, he can collect the wines himself by appointment from our warehouse. The customer will be able to cross intercommunity borders with a maximum of 90 liters of wine (i.e. 120 bottles of classic wine) per person.
Product presentation
The characteristics of the products offered for sale are described on the House of Wine company website. Photographs do not enter into the contractual scope. The House of Wine company cannot be held responsible if errors are introduced. All texts and images on the House of Wine company site are reserved, for the entire world, under copyright and intellectual property rights; their reproduction, even partial, is prohibited.
Guarantees
In the event of dissatisfaction, for example with corked wines, the buyer has up to 2 months (from the delivery date) to send their complaint to House of Wine. Beyond this period, the House of Wine company will no longer be able to guarantee the wines since no control over the quality of the storage location (an essential element in the conservation of wine) can be carried out, or the buyer will have to provide proof that the alteration of the wine predates the sale.
In order to allow House of Wine to appraise the wines itself, the buyer is kindly requested to leave them at its disposal; House of Wine will arrange their removal at its own expense. If the problem concerns 1 or 2 bottles, the buyer will be reimbursed for the value of the defective wines in the form of a credit (gift voucher). Beyond two bottles, reimbursement will be made by bank transfer.
Finally, the wines of the Grande Cave, rare wines and old vintages, will not be able to benefit from this guarantee either. These wines are offered for sale solely on the basis of notoriety without having been tasted beforehand by the House of Wine teams.
Termination of contract
In the event of non-payment by the customer on the agreed due date and one month at the latest, the sale will be automatically canceled if the seller sees fit, with restitution of any deposits paid by the buyer.
Jurisdiction
These general conditions of sale are subject to the application of Luxembourg law. The contractual information is presented in French, German and English (the French version being authentic) and the products offered for sale comply with Luxembourg legislation. If applicable, it is up to the foreign buyer to check with local authorities the possibilities of use and importation of the product he plans to order; the House of Wine company cannot be held liable in the event of non-compliance with national, international and European regulations.
Protection of minors
In accordance with the law which stipulates that the sale of alcohol to minors under sixteen (16) years of age is prohibited, the buyer undertakes, by completing the order form, to be sixteen (16) years of age on the date of the order by checking the appropriate box when ordering.
Right of withdrawal
The customer has a period of seven clear days from delivery of his order to return unwanted products in their original packaging with the original invoice, for exchange for a voucher, without penalty, at the ‘except for return costs. The customer must in all cases inform House of Wine in writing (email via the ‘Contact us’ link on the site, letter) of his decision before returning the goods. In the event that certain products have been opened, damaged or consumed, these products will be deducted from the voucher given to the customer.
Return costs are the responsibility of the customer.
On the other hand, in the event that the customer notices an anomaly on the part of House of Wine (example: product delivered does not conform to the product requested), House of Wine undertakes to reimburse all costs incurred by the customer: price of the product plus return costs and shipping costs, to the extent that the products are returned as is.
